Federal Shipping Law

- Hemp and hemp-derived products that contain no more than 0.3% delta-9 THC by dry weight remain federally legal to transport and ship across state lines under the 2018 U.S. Farm Bill.

- Products that exceed this THC threshold (including marijuana-derived THC products and high-THC consumables) are classified as controlled substances and cannot be shipped through the mail or common carriers.

Carrier Policies (USPS, UPS, FedEx, DHL)

- United States Postal Service (USPS): USPS generally allows mailing of hemp-derived products that comply with federal law (≤0.3% delta-9 THC), but may require documentation (e.g., Certificates of Analysis) and reserves the right to question compliance. 

Private Carriers (UPS, FedEx, DHL):

- UPS permits transportation of hemp and hemp derivatives only if compliant with federal, state, and local laws and may require proof of compliance; it may not accept certain formats (e.g., inhalables).

- FedEx has restrictive language that broadly prohibits shipping cannabis products, creating risk even for compliant hemp items; many sellers avoid it due to service suspensions or holds.

- Many carriers also prohibit shipping vape products and devices containing batteries or electronic delivery systems (per federal PACT Act and airline restrictions). 

State & Local Rules

- State laws can impose stricter requirements or outright bans. For example, certain states ban shipping or possession of products with total THC levels over 0.3% and may bar specific compounds (THCa included).

- You must comply with destination state law before shipping to that state.

Federal Hemp Definition Changes

- New federal provisions set to take effect in late 2026 may tighten compliance by capping total THC (all cannabinoids) per container and altering the hemp definition, potentially restricting some current hemp-derived products if not updated by legislation.

- Industry groups are currently working on legislative changes to delay or revise these limits. 

International Shipping

- International shipments face distinct THC limits by country and often stricter documentation; compliance requirements vary widely and failing to meet them can result in seizure or refusal.

- Many carriers have exited international hemp shipping due to complexity and legal risk.

International Shipping

Refused, Returned, or Seized Shipments

Orders that are refused, returned, delayed, or seized due to legal restrictions, carrier policies, or customer non-compliance with applicable laws are not eligible for refunds, replacements, or reshipment.
